সংক্ষিপ্ত শিরোনাম, প্রবর্তন এবং প্রয়োগ

১। (১) এই আইন বাংলাদেশ শ্রম আইন, ২০০৬ নামে অভিহিত হইবে।

  (২) এই আইন অবিলম্বে কার্যকর হইবে।   

(৩) এই আইনের অন্যত্র ভিন্নরূপ কিছু নির্ধারিত না থাকিলে, এই আইন সমগ্র বাংলাদেশে প্রযোজ্য হইবে।   (৪) উপ-ধারা (৩) এ যাহা কিছুই থাকুক না কেন, এই আইন নিম্নলিখিত প্রতিষ্ঠানসমূহ বা শ্রমিকগণের উপর প্রযোজ্য হইবে না, যথাঃ-  

 (ক) সরকার বা সরকারের অধীনস্থ কোন অফিস;   

(খ) সিকিউরিটি প্রিন্টিং প্রেস;   

(গ) সমরাস্ত্র কারখানা;   

(ঘ) অসুস্থ, অক্ষম, বৃদ্ধ, দুঃস্থ, প্রতিবন্ধী, এতিম, পরিত্যক্তা মহিলা বা শিশু অথবা বিধবাদের চিকিৎসা, যত্ন বা সেবার জন্য পরিচালিত কিন্তু মুনাফা বা লাভের লক্ষ্যে পরিচালিত নহে, এইরূপ কোন প্রতিষ্ঠান;   

(ঙ) প্রকাশ্য প্রদর্শনীতে ইহার প্রয়োজনে স্থাপিত এমন দোকানপাট বা স্টল যাহাতে শুধু খুচরা বেচাকেনা চলে;   

(চ) প্রকাশ্য মেলায় বা বাজারে ধর্মীয় বা দাতব্য উদ্দেশ্যে স্থাপিত দোকানপাট বা স্টল;   

(ছ) 1[মুনাফা বা লাভের জন্য পরিচালিত নহে এমন] শিক্ষা, প্রশিক্ষণ বা গবেষণা প্রতিষ্ঠান;   

(জ) মুনাফা বা লাভের জন্য পরিচালিত নহে এমন ছাত্রাবাস বা মেস2[,হাসপাতাল, ক্লিনিক ও ডায়াগনস্টিক সেন্টার];   

(ঝ) দ্বিতীয় অধ্যায়ের প্রয়োগের ক্ষেত্রে, সরকারের মালিকানাধীন এবং সরকার কর্তৃক সরাসরিভাবে পরিচালিত এমন কোন দোকান বা শিল্প বা বাণিজ্য প্রতিষ্ঠান যাহাতে শ্রমিকগণ সরকারী কর্মচারীগণের উপর প্রযোজ্য আচরণবিধি দ্বারা পরিচালিত হন;   

(ঞ) এমন কোন শ্রমিক যাহার নিয়োগ এবং চাকুরির শর্তাবলী সংবিধানের অনুচ্ছেদ ৬২, ৭৯, ১১৩ বা ১৩৩ এর অধীন প্রণীত আইন বা বিধি দ্বারা পরিচালিত হয়, তবে দ্বাদশ, ত্রয়োদশ এবং চতুর্দশ অধ্যায় প্রয়োগের ক্ষেত্রে নিম্নলিখিত প্রতিষ্ঠানে নিযুক্ত কোন শ্রমিক এই নিষেধের অন্তভূর্ক্ত হইবেন না, যথাঃ-  

 (১) রেল বিভাগ;   

(২) ডাক, তার ও টেলিফোন বিভাগ;   

(৩) সড়ক ও জনপথ বিভাগ;   

(৪) গণপূর্ত বিভাগ;   

(৫) গণস্বাস্থ্য প্রকৌশল বিভাগ;   

(৬) বাংলাদেশ সরকারী মুদ্রণালয়।   

(ট) দফা (খ), (গ), (ঘ), (ঙ), (চ), (ছ), ও (জ)- তে উল্লিখিত কোন প্রতিষ্ঠানে নিয়োজিত কোন শ্রমিক, তবে দ্বাদশ, ত্রয়োদশ এবং চতুর্দশ অধ্যায়ের প্রয়োগের ক্ষেত্রে কোন বিশ্ববিদ্যালয়ে নিযুক্ত, শিক্ষক ব্যতীত, অন্য কোন শ্রমিক এই নিষেধের অন্তভুর্ক্ত হইবেন না;   

(ঠ) দ্বাদশ, ত্রয়োদশ এবং চতুুর্দশ অধ্যায়ের প্রয়োগের ক্ষেত্র ছাড়া অন্য কোন ক্ষেত্রে, কোন নাবিক;    3[***]

(ঢ) এমন কোন কৃষি খামার যেখানে সাধারণতঃ 4[পাঁচ] জনের কম শ্রমিক কাজ করেন;   

(ণ) গৃহ পরিচারক; এবং   

(ত) এমন কোন প্রতিষ্ঠান যাহা উহার মালিক কর্তৃক পরিবারের সদস্যগণের সাহায্যে পরিচালিত হয় এবং যাহাতে মজুরীর বিনিময়ে কোন শ্রমিক নিযুক্ত থাকেন না।
