৩০৯৷ (১) এই অধ্যায়ের অন্যত্র যাহা কিছুই থাকুক না কেন, কোন ব্যক্তি এই আইন বা কোন বিধি, প্রবিধান বা স্কীমের কোন বিধান লঙ্ঘন করিলে, তিনি-
(ক) যদি উক্ত লংঘনের কারণে প্রাণহানী হয় তাহা হইলে চার বত্সর পর্যন্ত কারাদণ্ডে, অথবা এক লক্ষ টাকা পর্যন্ত অর্থদণ্ডে, অথবা উভয় দণ্ডে দণ্ডনীয় হইবে;
(খ) যদি উক্ত লংঘনের কারণে সাংঘাতিক শারীরিক জখম হয় তাহা হইলে, দুই বত্সর পর্যন্ত কারাদণ্ডে, অথবা দশ হাজার টাকা পর্যন্ত অর্থদণ্ডে, অথবা উভয় দণ্ডে দণ্ডনীয় হইবেন; অথবা
(গ) যদি উক্ত লংঘনের কারণে কোন প্রতিষ্ঠানে কোন শ্রমিক বা অন্য কোন ব্যক্তি অন্যভাবে জখমপ্রাপ্ত হন বা তাহার অন্য কোন বিপদ সৃষ্টি হয় তাহা হইলে, ছয় মাস পর্যন্ত কারাদণ্ডে, অথবা দুই হাজার টাকা পর্যন্ত অর্থদণ্ডে, অথবা উভয় দণ্ডে দণ্ডনীয় হইবেন৷
(২) কোন আদালত এই ধারার অধীন অর্থদণ্ডের আদেশ প্রদানকালে দণ্ডের আদায়কৃত অর্থের সম্পূর্র্র্ণ বা কোন অংশ ক্ষতিপূরণ হিসাবে জখম প্রাপ্ত ব্যক্তিকে অথবা, তাহার মৃত্যু হইলে, তাহার আইনগত প্রতিনিধকে প্রদানের জন্য আদেশ দিতে পারিবে৷
(৩) এই আইন বা কোন বিধি, প্রবিধান বা স্কীমের উক্তরূপ লংঘনের জন্য উচ্চতর কোন শাস্তির ব্যবস্থা থাকিলে ইহার ক্ষেত্রে এই ধারার কোন কিছুই প্রযোজ্য হইবে না৷
